Among the changes in the new Traffic Law for 2023, one of the most significant is a general review of fines throughout the country. 

With new laws recently announced, the government has been working quickly to implement systems that allow citizens to be fined more easily and accurately.

Brazil recently made changes to its traffic code, mainly regarding fines, which came into effect at the beginning of 2023. 

Thus, with Law 14.701, new rules are in effect, but a large number of drivers are unaware of some of them.

Therefore, it is important that drivers are well informed about these updates and remain vigilant regarding the law. Here are some of those changes.

Low beam

Very well, most drivers are already accustomed to the rule that requires the use of low-beam headlights during the day when driving on roads throughout the country.

However, despite the safety this measure offers, the rule changed from 2023 onwards. It is only mandatory for those traveling on single-lane roads.

Is there a maximum age for driving?

At what age can you no longer drive in Brazil? There is no maximum age, but there are some new rules for renewing your driver's license.

In other words, it is no longer mandatory to drive with headlights on on dual carriageways, those that have a separation between the lanes such as guardrails, medians or barriers, for example.

Furthermore, drivers of vehicles equipped with DRL technology, which are typically LED lights that remain on even when the headlights are off, do not need to turn on their low beams.

So, another new aspect of the new traffic law, and one of the changes to fines in 2023, is the authorization to turn right even when the traffic light is red, as long as it is properly signaled at the location of the maneuver.

This measure is already common in several other countries, such as the United States, for example.

However, be aware that the maneuver can only be performed at traffic lights with a sign indicating a right turn, even if the light is red.

If there is no signage, making the turn remains prohibited and subject to a fine.

Window tinting law

Very well, among the changes regarding fines that occurred in 2023, we also have the one concerning the use of window tint.

Thus, among the violations subject to fines are the presence of bubbles due to the incorrect application of window film on the windshield and front side windows.

Furthermore, the minimum light transmittance was regulated, that is, whether the film is darker or lighter.

The new law sets the percentage of light that passes through window film at 70%, regardless of its color. Previously, this percentage was 75% for colorless films and 70% for colored films.

The fine for this infraction is R$195.23 and five points on the driver's license, in addition to the vehicle being impounded until the infraction is rectified.

In addition to fines, another very important aspect of the changes to traffic laws in 2023 concerns the maximum points accumulated during a 12-month period, which can lead to the seizure of the driver's license.

Thus, the maximum score of 20 points will occur when there are two or more very serious infractions, according to the Traffic Code. However, if there is only one very serious infraction, the maximum score is 30 points. 

On the other hand, if only minor or moderate infractions are committed, the maximum score is 40 points. 

Weight Limit

Well, among the new rules of the Traffic Code, we also have the one that requires visible signage on the vehicle's structure indicating the weight capacity of each of its axles.

This information must also be included in the vehicle's registration document (Renavam). Therefore, the new rule stipulates a fine of R$ 130.16, plus the amount corresponding to the excess cargo weight.

Furthermore, the infraction is considered moderate, and the driver will have 4 points added to their driver's license. However, there are some exceptions for vehicles traveling on roads or highways in rural areas without pavement.

This will encourage transportation and logistics companies to operate their fleet safely and responsibly. It also serves to protect bridges and highways from potential damage that excessively heavy vehicles can cause.

New driver's license categories

Therefore, the new driver's licenses will now have a new classification in relation to the driver's category.

Thus, within the already known categories identified by the letters A, B, C, D, and E, categories A1, B1, C1, and BE were included. These are unknown to most drivers.

Thus, these new codes were introduced to follow an international standardization. The intention is to facilitate enforcement by traffic officers when the driver is driving outside the country.
