What are cars or motorcycles for people with disabilities?
Very well, Law 8.989/1995 defines cars for people with disabilities as:
…passenger cars manufactured domestically, with an engine displacement not exceeding 2,000 cm³ (two thousand cubic centimeters), with at least 4 (four) doors, including the one providing access to the luggage compartment, powered by renewable fuel, a reversible combustion system, or hybrid and electric vehicles…
The definition for motorcycles is as follows:
…motorcycles or mopeds manufactured domestically equipped with an engine displacement not exceeding two hundred and fifty cubic centimeters…
Therefore, the authority responsible for validating tax exemptions is the Federal Revenue Service. Thus, an initial analysis is carried out to ensure that the individual meets the conditions established by law.
Furthermore, there are state and federal laws guaranteeing exemption from certain taxes, such as IOF and ICMS, on the purchase of vehicles by people with disabilities.
Therefore, automakers have been adapting to the market. But due to price limitations, in some cases the models still come with few accessories and equipment.
What is the exemption limit for the purchase of vehicles for people with disabilities (PCD)?
In September 2023, Confaz approved increasing the ICMS exemption limit for vehicles purchased by people with disabilities, from R$100,000 to R$120,000.
The new spending cap will take effect on January 1, 2024; however, its implementation depends on ratification by the states.
The partial exemption, which previously applied to R$70 thousand, remains, and the buyer pays ICMS proportional to the amount exceeding that sum, even with the new limit. The limit for IPI exemption remains R$200 thousand.

Chevrolet Onix Turbo

- Taxi drivers, while practicing their profession, are eligible to apply for tax exemption every two years.
- Workers' cooperatives and companies that are authorized or licensed to provide public passenger transport services in the taxi category also have the right to request this privilege.
Other criteria necessary to obtain tax exemption when purchasing vehicles for individuals with critical illnesses include:
General Criteria
- Having financial means or assets equivalent to the price of the vehicle to be purchased, unless the purchase is made through a bank loan.
- To be free from any legal restrictions that may prevent obtaining tax advantages.
- For those who contribute to the General Social Security System as individual contributors, it is necessary to have no outstanding debts with social security.
Specifically for Professional Drivers
- The driver's National Driver's License (CNH) must indicate that he or she is engaged in the paid activity of taxi driver, as established in paragraph 5 of article 147 of Law No. 9.503/1997.
- Furthermore, the driver must not have any criminal penalties or convictions that disqualify them from obtaining tax benefits.
