What is DPVAT and what is its purpose?

Well, DPVAT is mandatory insurance that must be paid by any owner of motor vehicles.
So, be aware that if you are in default on this insurance, you will not be entitled to compensation.
Furthermore, without paying the DPVAT (mandatory traffic accident insurance), the owner cannot register their vehicle or transfer ownership to another person.
In summary, DPVAT is used to compensate Brazilians throughout the country if they have been victims of an accident involving a self-propelled vehicle traveling on land, whether on paved or unpaved roads.
Thus, the request can be made in cases of death, total or partial permanent disability, and to cover expenses for medical treatments.
Furthermore, accidents involving other types of transportation, such as trains, boats, and airplanes, are not covered by this insurance.

Who is entitled to receive DPVAT insurance?
Well, check below the beneficiaries who are entitled to receive DPVAT insurance depending on the type of incident, i.e., death, total or partial permanent disability, or expenses for treatment that are necessary due to the accident.
Therefore, in the event of death, half of the insurance payout will be paid to the deceased's spouse, provided they are not legally separated, and the other half will go to the victim's heirs.
In this case, beneficiaries must present the following documentation to receive the benefit: death certificate, police report of the incident, and documents proving their status as spouse or legal heir.
Furthermore, if these individuals are unavailable, the compensation will be paid to the person who can prove that they depended on the victim to meet their basic needs.
In the case of total or partial permanent disability, the compensation will be paid to the victim themselves.
In this case, the victim themselves must present the police report of the incident and also a medical report attesting to the type and degree of injury, which are specified in percentages defined in the annex of Law 6.194/74.
Furthermore, the victim will be reimbursed for medical, hospital, or pharmaceutical treatments within the private healthcare system.
Here, the victim must also present the police report of the incident, but it must specify in the report who administered first aid to the victim and by whom.

But be aware! You will lose your right to compensation if you are in arrears with your insurance payments.

What does DPVAT cover?

In the event of death, the spouse and legal heirs are entitled to compensation up to R$ 13,500.
In the case of total or partial permanent disability, the victim will also be entitled to compensation of up to R$ 13,500.
Furthermore, victims of the accident will receive up to R$ 2,700 to cover medical, hospital, and pharmaceutical expenses in the private hospital network if they require such care.
And what does insurance not cover?
Well, DPVAT does not cover material damages, accidents without victims, accidents caused by foreign vehicles, or accidents that did not occur within the national territory.

Furthermore, you have up to 3 years after the accident to make the request.
The process is simple and you don't need the help of intermediaries to do it.
Be aware that there are many cases of charges for fees or fraud for services performed by third parties.
Therefore, make the request yourself or, if you are unable to do so, grant power of attorney to someone you trust to do it for you.
Finally, we remind you once again not to fail to make the payment for this insurance, which is a right guaranteed by law, as you will lose the right to compensation if you are in default.
Also, if the vehicle is sold, you will not be able to transfer ownership and you will also be unable to register it.
